NCIA Terms and Conditions
(1) NCIA exercises no control whatsoever over the content of information passing
through NCIA. NCIA makes no warranties of any kind, whether expressed or implied, for the service its
providing. NCIA also disclaims any warranty of merchant ability or fitness for a particular purpose.
NCIA will not be responsible for any damages you suffer. This includes loss of data resulting from delays,
non delivers, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions.
Use of any information obtained by NCIA is at your own risk. NCIA specifically denies any responsibility for
the accuracy or quality of information obtained through its service.
(2) NCIA may only be used for lawful purposes. Transmission of any material in violation of
any US or state regulation is prohibited. This includes, but not limited to: copyrighted material, material
legally judged to be threatening or obscene, or material protected by trade secret. You agree to indemnify
and hold harmless NCIA from any claims resulting from your use of service which damages you or another party.
(3) Any access to other networks connected to NCIA must comply with rules appropriate for
that other network. This specifically, but not exclusively, includes NCIA. Use of NCIA itself may be for any
lawful purpose. Use of NCIA for lawful commercial purposes is both permitted and encouraged.
(4) Connectivity is provided for your use only. Accounts are not to be shared with other
individuals. You can have only one modem or connection to your account at a time. Multiple logins are prohibited
with a standard dial-up account. If you require multiple connections, a dial-up account must be purchased for
each connection to our dial-up network. Resale of direct IP connectivity to other individuals or organizations
is strictly prohibited.
(5) Payment is due in advance for each month of service. Accounts are in default if payment
is not received within 1O days after monthly billing date. If your payment is returned to NCIA unpaid you are
immediately in default and subject to a returned check charge of $25 from NCIA. Accounts unpaid 30 days after
date of invoice may have their service interrupted. Such interruptions does not relieve you from the obligation
to pay the monthly charge. Accounts in default are subject to an interest charge of 1.5% per month on the
outstanding balance. If you default, you agree to pay NCIA its reasonable expenses, including attorney and
collection agency fees, incurred in enforcing its rights under these terms and conditions.
(6) Billing for NCIA service will normally commence when the connection from NCIA hub
is completed to your site and IP packets or shell account data can be passed. Your first month fee and
registration fee must be paid in advance. Accounts that are activated mid-cycle will be adjusted on the
next billing. Subsequent monthly billing will occur on the first week of each month, and you will be
invoiced in advance for the next month. Additional time and or services will be billed for the previous
month on your monthly invoice. Service may be canceled in writing with 60 days notice without penalty.
NCIA reserves the right to change the rates. Registration Fees are non-refundable.
(7) These terms and conditions supersede all previous representations, understandings
or agreements and shall prevail notwithstanding any variance with terms and conditions of any order
submitted. Use of NCIA constitutes acceptance of these terms and conditions.
Unacceptable Uses of NCIA Internet Services
In addition to use of Internet Services for any illegal purposes (some of which are
described below), it is a violation of the Acceptable Use Policy to:
(1) Send unsolicited bulk e-mails, chain-letters or mass advertising, harvest e-mail addresses
for the purpose of sending bulk e-mails or mass advertising, or otherwise engage in spamming.
(2) Engage in excessive multiple posting to newsgroups. As a general rule, this entails posting
the identical or nearly identical message to 10 or more groups within a two-week period. Users should become
familiar with and comply with the guidelines or community standards governing the newsgroups in which they participate.
(3) Engage in mailbombing or otherwise interfere with or disrupt other network users, network
services or network equipment (e.g., by transmitting a virus or other software, code or files intended to limit or
disrupt the function of any software, hardware or telecommunications equipment).
(4) Use network resources in excess of any prescribed limits on bandwidth or disk utilization.
For example, it is a violation of this Acceptable Use Policy to stay logged on to our Internet Services when you
are not actively using your account unless you have a dedicated account with us.
(5) Resell our Internet Services to others without our written permission. Obtain, or attempt to
obtain, unauthorized access to, monitor, or use any data, systems, or networks without the express permission
of the owner.
(6) Relay mail via another site's mail server without express permission of that site.
(7) Cancel any postings or messages other than your own, except for postings in your name that
have been forged.
(8) Impersonate any person or entity, including any employee or representative of NCIA.
(9) Disclose your password for accessing our Internet Services to a third party, or otherwise
facilitate unauthorized access.
(10) Add, remove or modify identifying network header information ("spoofing") in an effort to
deceive or mislead, or any attempt to impersonate any person by using forged headers or other identifying information.
The use of anonymous remailers or nicknames does not constitute a violation of this provision.
(11) Transmit, post, store, link or distribute another's intellectual property or proprietary
information, including trade secrets, trademarks, right of publicity or copyright information, without express
authorization of the rights holder.
(12) Pursuant to the Digital Millennium Copyright Act, accounts of users who repeatedly infringe
the copyrights of others must be terminated.
(13) Transmit, post, store, link or distribute any material that is obscene, contains explicit
or graphic descriptions or accounts of sexual acts or sexual language of a violent or threatening nature or
constitutes child pornography under applicable law.
(14) Threaten bodily harm, destruction of property or otherwise engage in harassment.
(15) Transmit, post, store, link or distribute any threatening, abusive, harassing, defamatory,
libelous, deceptive, fraudulent or tortious information or information that is invasive of another's privacy.
(16) Transmit, post, store, link or distribute material that victimizes, harasses, degrades,
threatens to harm or intimidates an individual or group of individuals, including without limitation minors, on
the basis of religion, gender, sexual orientation, race, ethnicity, age or disability.
You are fully responsible for all use of our Internet Services via your account. If any user of
your account is suspected of violating this Acceptable User Policy, NCIA, among other things, investigate the
situation and, where appropriate, cooperate with law enforcement if a criminal violation is suspected.
Privacy Policy
NCIA may use Personal Information internally as well as combine it with other information about
you that is available to us, including information from other sources, and we may use it to alert you to new NCIA
products, services, surveys and special offers.
NCIA does not share subscriber data bases or email addresses with third parties.
NCIA respects the privacy of user's email. Exceptions are those permitted by law,
including under the Electronic Communications Privacy Act of 1986 (the "ECPA"). The ECPA permits NCIA,
limited ability to intercept and/or disclose electronic messages, including, for example (i) as necessary
to operate the system or to protect NCIA's rights or property, (ii) upon legal demand (court orders,
warrants, subpoenas) or (iii) where NCIA, receives information inadvertently which appears to pertain
to the commission of a crime. Users should be aware that electronic messages may be intercepted lawfully
or unlawfully outside of NCIA's system. In addition, although NCIA has implemented certain security measures,
NCIA cannot guaranty that its system or stored data of a customer will be free from unauthorized
intrusion or otherwise guaranty the privacy of information of any user.
NCIA understands how important it is to keep your personal information confidential and we work
hard to ensure
the safety of it. This NCIA privacy policy defines NCIA's commitment to respecting your privacy.
Information Collected and How It Is Used
Your IP Address
An IP Address is automatically assigned to your computer every time you establish a connection through
one of our modems onto the Internet. NCIA uses your IP address to analyze trends, and to help diagnose
problems with our modems, servers and routing equipment. If required by law enforcement agencies or to
investigate violation of our Acceptable Use Policy we can trace any IP address back to the corresponding user account.
Your Account
When establishing an account with NCIA, you are asked for certain pieces of personal information, such as
(but not limited to), name, address, telephone number, billing information, mother's maiden name and your
operating system software. NCIA uses the personal information we collect principally to manage each user's
account, so we are able to bill and provide service to the individual. NCIA does not knowingly collect
personal information from children under the age of 18.
Additional Information Collected
Any personal correspondence you send to us, including e-mail, notes and letters may be gathered and stored.
Any ideas or suggestions submitted become the property of NCIA.
Disclosure of Information
NCIA does not rent, sell, trade or disclose any user's personal information (including email addresses or
lists) and/or Internet communications to third parties unless specifically stated or in response to subpoenas
and other legal demands, or laws such as the Electronic Communications Privacy Act and where we believe that
disclosing this information is necessary to identify, contact or bring legal action against individuals
who may be endangering public safety or interfering with NCIA's property or services, or to protect our
users and NCIA. We do share information within our NCIA companies to help us better understand our customer's
product and service needs. We also may provide account information to collection agencies when customers
do not pay their bills.
Security
We work hard to safeguard our users' information and follow industry standard practices to protect personal
information submitted via our website. When filling out our online application all of the information you
submit including credit card information is encrypted through Secure Sockets Layer (SSL) software ensuring
that your information cannot be read by others.
We also do everything possible to protect user information off-line ensuring that your information cannot
be accessed outside the company. All NCIA employees with access to personal information are required to
keep customer information confidential and all of our employees are kept up to date on our security and
privacy practices.
How to Access or Update Your Information
You can access or update your personal account information at any time. Contact our office at 603-752-1250
to update or change your information. To ensure the safety of your personal information we take steps to
verify your identity before we grant access or update your information.
